Sub: Appeal to appellate authority based on the RTI reply from Mayyanad Gramapanchayat.

We believe we have been denied information which has been sought from the Secretary, Mayyanad Gramapanchayat. Against the question which has been asked we are inputting our needs & answers for your perusal & due consideration. Please see below against Janasakthi name as (Janasakthi>>).      Also we requested information in electronic form as per the below mentioned clauses of the act. I trust that was not the essence of the reply, request that full compliance has to be met. We would be happy to receive all such documents in electronic form where ever possible. Gramapanchayat secretary’s reply is also attached here with.        

 Section 2i(d): any other material produced by a computer or any other device;

Section 2j(iv), obtaining information in the form of diskettes, floppies, tapes, video cassettes or in any other electronic mode or through printouts where such information is stored in a computer or in any other device;

  Section 2(f): “information” means any material in any form, including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force;  Moreover it appears to us from the answers and the happenings on the ground, there is a deliberate attempt to falsify and deny the information. This information was not answered and its violation of RTI Act

1. What are the obligation/duties of the Gram Panchayat with respect of Conservation & Preservation of Paddy field in the Grama Panchayat as per Panchayat Raj Act?

Janasakthi>> This we don’t believe is ignorance, but a deliberate attempt to hoodwink the spirit of the information sought. THE KERALA PANCHAYAT RAJ ACT,I994, section 4 specifically section 4.2 dwells at length on this. Moreover 166(1) of the Panchayat Raj act relating to the duties and responsibilities of gramapanchayat in section ‘C’ sectoral responsibilities states 13 items under agriculture. So this question was not answered & the answer has not been supplied thus its violation of RTI Act.

2. A)Also do provide a copy of relevant act/Government Order mentioned in point1

B)Furnish Grama Pnchayat Maps in respect of the following:-

i.Geo-graphical boundaries, administrative wards,roads,railwaylines,lakes, thodus, irrigation canals etc.

ii. Cropping patterns for Paddy crop-Virippu, Mundakan and Puncha and Garden land, marshy land

iii.Area in Ha. Under various crops

Janasakthi>> As per answer to Q.1 its completely binding, moreover as per RTI Act section 6(3) I & II, if the specified details is not available in the Panchayat, the details should be forwarded to the Agricultural officer Krishi Bhavan, Mayyanad or other concerned officers(regarding maps) within 5 days after receipt of the RTI. So this question was not answered & the answer has not been supplied and thus its a violation of RTI Act.

3.Provide an approved budget of the Panchayat for the year 2011-12.

4.What are the provisions for Conversion of Waste land for Paddy Cultivation?

Janasakthi>> As per RTI Act section 6(3) I & II, if the specified details is not available in the panchayat, the details should be forwarded to the Agricultural officer Krishi Bhavan, Mayyanad or other concerned officers, within 5 days after receipt of the RTI. So this question was not answered & the answer has not been supplied thus its violation of RTI Act.

5.What are the amount and schemes provided for point 4 in the last 5 financial years and funds received from various departments for the same as per Peoples Planning?

Janasakthi>> All the relevant required information has not been provided. So this question was not answered & the answer has not been supplied thus its violation of RTI Act 2005.

6.Also provide the ward wise allotment, expenditure, and allocation from which agency/department & beneficiary share for point 5.

7.State the area under paddy cultivation in hectares per ward for Virippu, Mundakan & Puncha crops.

8.Provide gross area cultivation of paddy in hectares per ward.

Janasakthi>> All the relevant required information has not been provided and the answer is very vague. So this question was not answered & the answer has not been supplied thus its violation of RTI Act.

9.What is the strategy adopted by the Panchayat to increase the area and yield of paddy cultivation.

Janasakthi>> All the relevant required information has not been provided and the answer is very vague. So this question was not answered & the answer has not been supplied thus its violation of RTI Act. Moreover As per RTI Act section 6(3) I & II, if the specified details is not available in the panchayat, the details should be forwarded to the Agricultural officer Krishi Bhavan, Mayyanad or other concerned officers, within 5 days after receipt of the RTI.

10.Does this year’s budget have any provision for point above? If not, state the reason why.

11.Also do provide the copy of circular or GO from the Government/planning board for preparation of perspective and annual plans.

Janasakthi>>All the relevant required information has not been provided and the answer is very vague. Both Planning Board & Government has issued clear instructions with regards to the same, and the copy has not been supplied. So this question was not answered & the answer has not been supplied thus its violation of RTI Act.

12.As per the instruction provide the minimum & maximum plan provisions ear-marked to the following sectors

a)Agriculture, b)Animal Husbandry & Diary, c)Fisheries, d) Women Development

Finally if we don’t get convincing information from your office we will be constrained to take it up with the Chief Information Commissioner, Trivandrum
